PoolSpace Contributor Protection Policy

This Contributor Protection Policy ("Policy") explains the protections, limitations, and responsibilities that apply to individuals who make contributions ("Contributors") to Pools on the PoolSpace platform. This Policy forms part of and must be read together with PoolSpace's Terms & Conditions, Privacy Policy, Acceptable Use Policy, and AML/KYC Policy.


1. Purpose of This Policy

The purpose of this Policy is to:

  • Provide transparency to Contributors about how Pools operate
  • Clarify the protections PoolSpace provides and the risks Contributors accept
  • Define PoolSpace's role and limitations in relation to contributions
  • Set expectations regarding disputes, refunds, and misuse of funds

PoolSpace is a facilitation and coordination platform and does not act as a trustee, escrow agent, guarantor, or financial intermediary.


2. Role of PoolSpace

2.1 PoolSpace enables Contributors to make payments to Pools created by Organisers for designated Beneficiaries.

2.2 PoolSpace does not:

  • Hold, store, or safeguard Contributor funds
  • Control or guarantee how funds are used after payout
  • Guarantee that a Pool's stated objective will be achieved

2.3 All payments are processed by third-party payment providers, and funds are paid directly to verified Beneficiaries in accordance with platform rules.


3. Contributor Acknowledgements

By making a contribution, Contributors acknowledge and agree that:

  • 3.1 Contributions are voluntary and final, and are made at the Contributor's own discretion and risk.
  • 3.2 PoolSpace does not guarantee the accuracy, completeness, or truthfulness of Pool descriptions, Organiser statements, or Beneficiary representations.
  • 3.3 PoolSpace is not responsible for disputes between Contributors, Organisers, or Beneficiaries.

4. No Refunds or Reversals

4.1 All contributions are final, non-refundable, and non-reversible, except where required by applicable law.

4.2 Contributions cannot be withdrawn, cancelled, or reclaimed once successfully processed, regardless of:

  • Whether the Pool reaches its goal
  • Any change in personal circumstances
  • Disputes between Organisers and Beneficiaries
  • Dissatisfaction with how funds are used

4.3 PoolSpace does not issue refunds and is not responsible for refund requests made to payment providers or financial institutions.


5. Verification & Risk Mitigation Measures

To reduce fraud and misuse, PoolSpace implements certain safeguards, which may include:

  • Identity verification of Organisers
  • Bank account verification for Beneficiaries
  • Locking of Beneficiary and payout details once contributions begin
  • Monitoring Pools for suspicious activity
  • Suspending or restricting Pools pending review

These measures are risk-based and do not guarantee the prevention of fraud.


6. Fraud, Misrepresentation & Suspicious Activity

6.1 If PoolSpace reasonably suspects fraud, misrepresentation, or illegal activity related to a Pool, it may:

  • Suspend or disable the Pool
  • Delay or freeze payouts
  • Restrict account access
  • Report the matter to payment partners or authorities

6.2 PoolSpace is not obligated to disclose investigation details to Contributors.

6.3 PoolSpace does not guarantee recovery of funds in cases of fraud or misuse.


7. Use of Funds
  • 7.1 Contributors acknowledge that PoolSpace does not control or monitor how funds are used after payout.
  • 7.2 Responsibility for lawful and appropriate use of funds rests solely with the Organiser and/or Beneficiary.
  • 7.3 PoolSpace disclaims all liability for misuse, misappropriation, or unlawful use of funds after payout.

8. Disputes Between Users
  • 8.1 PoolSpace does not mediate, arbitrate, or adjudicate disputes between Contributors, Organisers, or Beneficiaries.
  • 8.2 Contributors agree to resolve any disputes directly with the Organiser or Beneficiary.
  • 8.3 PoolSpace may, at its discretion, provide limited assistance by sharing publicly available Pool information or cooperating with lawful investigations.

9. Limitation of Liability

To the fullest extent permitted by law:

9.1 PoolSpace shall not be liable for:

  • Financial losses arising from contributions
  • Failure of a Pool to meet its objectives
  • Actions or omissions of Organisers or Beneficiaries
  • Delays, errors, or failures by payment providers

9.2 PoolSpace's total liability to any Contributor, if any, shall not exceed the service fees charged by PoolSpace in relation to the relevant contribution.


10. Contributor Responsibilities

Contributors agree to:

  • Use only authorized payment methods
  • Comply with all applicable laws and platform policies
  • Not engage in fraudulent, abusive, or misleading conduct
  • Understand the risks associated with contributing to Pools

Failure to comply may result in account suspension or termination.


11. Changes to This Policy

PoolSpace may update this Policy from time to time. Updates will be effective upon publication. Continued use of the platform constitutes acceptance of the updated Policy.


12. Governing Law

This Policy is governed by the laws of the Republic of South Africa, without regard to conflict-of-laws principles.
