PoolSpace Acceptable Use Policy (AUP)

1. Purpose

This Acceptable Use Policy ("AUP") governs the acceptable use of PoolSpace, its platform, services, technology, and interfaces (collectively, the "Services"). The purpose of this AUP is to protect the integrity, security, and reliability of the Services, to protect users and contributors, and to comply with applicable laws and third-party requirements. All capitalized terms not defined herein have the meanings assigned to them in PoolSpace's Terms of Use.


2. Applicability

This AUP applies to all users of the Services, including but not limited to:

  • Organisers
  • Beneficiaries
  • Contributors
  • Visitors
  • Registered and unregistered Users

By accessing or using the Services, you acknowledge and agree to comply with this AUP. PoolSpace may modify this AUP at any time, and your continued use of the Services constitutes acceptance of such modifications.


3. Prohibited Conduct

Users must not, directly or indirectly:

3.1 Illegal Activities
  • a) Use the Services for any unlawful purpose or in violation of applicable local, national, or international law, regulation, or order.
  • b) Facilitate or support illegal activities, including but not limited to fraud, money laundering, terrorism financing, illicit trade, or any form of unauthorized fundraising.
3.2 Misrepresentation, Fraud & Deception
  • a) Provide false, misleading, fraudulent, or inaccurate information in connection with identity verification, bank verification, pool creation, pool description, beneficiary designation, or contributor information.
  • b) Impersonate another person or entity, or misrepresent affiliation with a person, entity, or organization.
  • c) Engage in any activity designed to circumvent identity verification, risk controls, or payment partner safeguards.
3.3 Harmful or Abusive Content
  • a) Use of the Services to promote violence, discrimination, harassment, threats, hate speech, or content that promotes harm toward individuals, groups, or protected classes.
  • b) Upload, transmit, or distribute content that is illegal, defamatory, obscene, pornographic, harassing, or otherwise offensive.
3.4 Security Violations
  • a) Attempt to gain unauthorized access to any portion of the Services or systems.
  • b) Interfere with, disrupt, or compromise the integrity, security, or performance of the Services or any data stored or processed by PoolSpace.
  • c) Transmit malicious code (viruses, malware, ransomware) or engage in denial-of-service attacks, data scraping, bots, or similar automated processes.
3.5 Intellectual Property Abuse
  • a) Upload, use, or share content that infringes on intellectual property rights without authorization.
  • b) Remove or alter copyright, trademark, or proprietary notices in materials obtained through the Services.

4. Organiser & Beneficiary Obligations
4.1 Accuracy and Verification
  • a) Organisers and Beneficiaries must provide accurate legal names, identification information, bank account information, and contact details.
  • b) Users must comply with all identity and bank verification procedures required by PoolSpace and its payment partners.
4.2 Use of Funds
  • a) Funds collected through a pool must be used for the purpose and objective described in the pool's description.
  • b) Organisers are responsible for all legal and financial obligations related to the use of collected funds and acknowledge that misuse of funds may result in account suspension, legal action, or reporting to authorities.
4.3 Pool Descriptions
  • a) Pools must contain truthful, clear, and non-misleading descriptions of the purpose, beneficiary, and use of contributions.
  • b) Organisers must not change or amend the stated purpose or beneficiary after public contributions have been received.

5. Contributor Responsibilities

Contributors must:

  • a) Use valid, authorized payment methods.
  • b) Not contribute using stolen or unauthorized financial instruments.
  • c) Comply with any eligibility requirements for making contributions (such as age or jurisdictional restrictions).

6. Enforcement and Remedies
6.1 Actions PoolSpace May Take

PoolSpace, in its sole discretion, may:

  • a) Suspend or terminate any account or access to the Services for violations of this AUP.
  • b) Freeze or reverse contributions or transactions that violate this AUP or applicable law.
  • c) Remove, restrict, or refuse to display content that violates this AUP.
  • d) Restrict access to pools or features pending verification or investigation.
6.2 Reporting to Authorities

PoolSpace may report any suspected illegal activity, fraud, terrorism financing, money laundering, or abuse to law enforcement, regulatory agencies, or relevant authorities where required by law or by payment partners.


7. No Liability for User Conduct

PoolSpace is not responsible for the conduct, promises, representations, or actions of any user. PoolSpace expressly disclaims any liability arising from user-generated pools, campaigns, content, or transactions. Users agree that PoolSpace shall not be liable for any losses, damages, or claims arising from or in connection with the conduct of other users.


8. Cooperation with Third Parties

Users acknowledge and agree that PoolSpace may share user information as necessary to:

  • a) Comply with legal obligations.
  • b) Respond to lawful requests from authorities.
  • c) Cooperate with payment service providers, banks, and verification partners.
  • d) Enforce this AUP or protect the rights, safety, or property of PoolSpace, its affiliates, or its users.

9. Changes to the Policy

PoolSpace may update, amend, or refine this AUP at any time. Updated versions will be posted and effective upon posting. Continued use of the Services after posting constitutes acceptance of the updated policy.


10. Governing Law

This AUP shall be governed and interpreted in accordance with the laws specified in the PoolSpace Terms of Use, without regard to conflict of laws principles.
